1. Acceptance of Terms
   By accessing or using Turbulence Forecast (“Service”), you (“User”) agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

   • Consumer Forecasts – On-demand or subscription turbulence forecasts intended to assist—but never replace—your own judgment and official crew instructions.

   • Commercial Data Feeds – Licensed turbulence data, APIs, or files supplied to aviation-industry clients (“Commercial Users”) for operational or analytical use.

3. No Safety Guarantee
   Turbulence is inherently unpredictable. All forecasts and data are probabilistic and provided “AS IS.” They are not flight-planning, dispatch, or air-traffic-control products and must never be the sole basis for safety-critical decisions. Always follow government advisories and pilot-in-command instructions.
   

4. Assumption of Risk
   By choosing to leave a seat, loosen a seat belt, or otherwise act in reliance on any forecast or data from the Service, you acknowledge these actions carry inherent risks of bodily injury and accept those risks as your own.

5. Intellectual Property & License
   All models, data, text, and graphics are owned by Turbulence Forecast or its licensors.

   • Consumers – Personal, non-transferable, non-commercial license.

   • Commercial Users – Non-exclusive license solely for the purposes stated in your signed order form or master service agreement (if any). Redistribution or resale requires prior written consent.

6. Fees, Billing & Refunds

   • Fees are shown at checkout or in your order form and are billed in USD.

   • Non-payment suspends access.

   • Our sole remedy to you for any problem is, at our option, (a) re-delivery of the Service or (b) a refund of what you paid for that specific forecast or the prorated portion of your subscription/contract.

7. Limitation of Liability
   To the fullest extent allowed by law, Turbulence Forecast, its owners, and affiliates are not liable for any indirect, incidental, special, or consequential damages—including personal injury, death, property damage, lost profits, or lost flight revenue. Direct damages, if any, are capped at the total fees you paid to Turbulence Forecast in the 30 days immediately preceding the claim.

8. Service-Level Commitment (Commercial Users)
   Turbulence Forecast will use commercially reasonable efforts to maintain 99.5 % uptime for its Commercial Data Feed in each calendar month. If we do not meet this uptime target, you may request a service credit equal to a prorated portion of the fees paid for that month. Service credits are your sole and exclusive remedy for any failure to meet this commitment.

9. User Obligations

   • Provide accurate account and payment information.

   • Do not reverse-engineer, scrape, or misuse the Service.

   • Commercial Users must implement reasonable safeguards to prevent unauthorized access to licensed data.

10. Privacy
    Your use is also subject to our privacy policy, which explains how we handle personal and usage data.

11. Governing Law & Dispute Resolution
    These Terms are governed by the laws of the State of Michigan, USA (without regard to conflict-of-law rules). Any dispute will be heard exclusively in the state courts located in Oakland County, Michigan (including Troy, MI) or the federal courts sitting in the Eastern District of Michigan, and you consent to that venue.

12. Changes to Terms
    We may update these Terms by posting a revised version on our website. Material changes take effect 30 days after posting. Continued use after that means you accept the new Terms.

13. Severability & Entire Agreement
    If any provision is held unenforceable, the rest of the Terms remain in effect. These Terms—plus any signed commercial agreement—are the entire agreement between you and Turbulence Forecast regarding the Service and supersede all prior understandings.
